TTC considers suing Bombardier after latest delivery date promise misses target

The Toronto Transit Commission might sue Bombardier over failures to meet its delivery dates for streetcars built in Thunder Bay.

The TTC said Bombardier told them Thursday that a July 29 promise to deliver 23 streetcars by the end of the year won't be met. While the original contract stated that 67 of the 204 cars should already be in operation in Toronto, only 10 are. The company said it will deliver 16 streetcars by the end of the year but in a media release, TTC said it now has no confidence that Bombardier will deliver on that promise.

TTC staff are recommending that legal action be taken against the company for $50 million because of late delivery. It will also look for damages for maintenance and overhaul costs, service and customer impact costs and staff time.

"I am incredibly disappointed to learn that Bombardier, yet again, will not be meeting their commitments to deliver new streetcars to Toronto," TTC chair Josh Colle said in a media release.

"They have let down the TTC, our customers, the good workers in Thunder Bay and all Toronto residents. We will not let Bombardier's incompetence hold our patient and loyal customers hostage. We will consider all legal and financial actions at our disposal to address this situation."
