Bombardier contract moved from local plant may now be subject of legal action

TORONTO, Ont. – Metrolinx may be moving forward with legal action against Bombardier for breach of contract due to the ongoing turmoil involving its light rail vehicle contract.

TORONTO, Ont. – Metrolinx may be moving forward with legal action against Bombardier for breach of contract due to the ongoing turmoil involving its light rail vehicle contract.

Originally a project for the Thunder Bay Bombardier plant, the 182 LRT-vehicle Metrolinx contract was shipped to Kingston. The move was made to allow the local plant to focus exclusively on its $1-billion TTC streetcar contract, which has failed to meet deadlines on multiple occasions.

A new report by the Toronto Star indicates that the move to Kingston hasn’t fully satisfied Metrolinx.

A Wednesday report by The Star, which attributes “sources with knowledge of discussions, indicates Metrolinx has issued a notice of default to Bombardier last week that claims the company is in breach of contract for the LRT contract.

The Star then speculates that the notice may be a precursor to the filing of a claim for damages against Bombardier.

Originally Bombardier was scheduled to produce an LRT vehicle for testing in 2014. That deadlines was moved to spring 2015, but Metrolinx is said to be still waiting on its arrival.
