Officer avoids jail time in mischief case

A veteran OPP officer who pleaded guilty to mischief and willfully obstructing a woman's e-mail account has managed to avoid jail time.

48-year-old Claude Montfort was a constable in Terrace Bay when the offences occurred between 2005 and 2007. Court heard Montfort accessed the victim's computer account on 23 occasions, changed her passwords and sent malicious e-mails containing personal details. Several of the incidents occurred while Montfort was on police duty.

His lawyer had been seeking a conditional discharge, but the judge agreed with the Crown and registered a conviction on both charges. However, the judge handed down a suspended sentence, meaning Montfort will not spend any time in custody. He was also given three years probation, a $500 fine and was ordered to stay away from the victim and not use the Internet.

Now that his criminal case has been dealt with, Montfort will next be facing a Police Services Act investigation. He's been on sick leave from the OPP since 2007.

Nice....break the law, and get a 3 yr paid vacation. ...and these are the people who we trust to protect & serve!?! I gotta get in on that racket.

Sick leave since 2007. Getting paid to do nothing on taxpayers dollars while in court for abusing the rights of a taxpayer. Something is wrong here, is it just me?

noooo, a cop gets off easier when he breaks the law!!!???(sarcasm). why does this happen, why is it allowed to happen? the police are sworn to uphold the law, they should get even tougher sentences for breaking it!!! someone who takes an oath, and is sworn to serve,protect, and given the trust of the people,in my opinion, deserves much more severe punishments than those that have not.
this is just another example of how messed up our system is, when are people going to learn....

This is pathetic, if anyone else had done the same thing they would have had a more severe punishment, but since he's an OPP officer he gets off light. Im sick of cops getting away with crap like this, this guy doesnt deserve to wear the uniform.

Why is it when cops break the law, they seem to get off a lot lighter than any other person does.

This is a prime example of a two tiered system of justice.

No different that the various incidents of our local police members behaving badly, only to be punished with paid leave.

maybe your questions should be better directed elsewhere if you think money is being wasted

as for officers behaving badly, I suppose the issue comes down to this

john smith commits a crime and gets probation because he has no past criminal history
officer jones commits the exact same crime and has no prior criminal history

should he be treated the same or more harshly because he is a police officer

that to me is the discussion and I for one can understand the position of treating that officer more harshly.

right now he is not getting away with the crime any more than someone else has, but given that his position is one to prevent crime, there is a very good reason to suggest the punishment should be more harsh
