As expected, the city has launched its appeal of last month's court ruling regarding Horizon Wind Inc. 

Back on Jan. 18 a Superior Court judge in Toronto turned aside a request from the city to have Horizon's $126-million lawsuit settled through arbitration. The decision was reportedly based on the absence of an arbitration provision in the contract between the two sides.

But city officials dispute that, and are saying there are arbitration provisions in a lease agreement tied to the deal. 

The lawsuit was launched after the city demanded the location of four of the proposed wind turbines be changed. 

No date has been set for the appeal to be heard.
