A passenger in a pick-up truck escaped serious injuries Wednesday night when the vehicle he was traveling in careened into a ditch along Highway 61.

OPP called to the scene, just south of Hacquoil Road, said there were three people in the pick-up, which left an arc of thick skid marks on the newly paved highway as it veered off the road and through the underbrush, coming to rest on its wheels.

Police said all three went to hospital, though two were walking around and did not appear to be seriously hurt. The third did suffer non life-threatening injuries.

According to a witness, the pick-up was driving southbound on the highway and attempted to pass two slower-moving vehicles ahead of it. The first vehicle, towing a trailer, attempted to make a left-hand turn as the yellow pick-up began the passing maneuver. The truck clipped the first vehicle and swerved to avoid further damage.

Police said charges are pending, though could not say who would be charged in the incident.

The investigation continues.

First off I hope everyone is ok...second I have seen this truck with the large green John Deer sticker in the back window driving erratically on more than one occasion...usually speeding, cutting in and out of traffic and tailgating...

assumptions thrill me says:
Hey there everyone, I personally know the person who drives that truck with the John Deere sticker, he is about the most selfless person you can meet. He lives his life working out of town, and comes back and volunteers for his community. (firefighting and first responding) Ya he sometimes does have a heavy foot. And sometimes its going to emergency calls. He does anything to help someone out when needed. He has also pulled many others out of these situations (fires, accidents, and medical emergencies, with the training he has had. He receives a small amount for the effort he puts in while volunteering. You are also aware that he can see everything above and passed you right. But if you really need to judge My friend because his truck stands out, and because he ocasionally passes, by all means.

Obviously, dandy, the comment was made to make a point that many people on this forum are too quick to judge individuals without knowing all the facts. It is easy to do when you are sitting behind a computer screen.

Wow, thank goodness their all okay, in cases like these the person turning left wont be charged if he had signal led properly, such a shame, but thankfully their all okay
9/5/2012 10:50:26 PM
Sui Generis says:
The person turning left is required by law to check for oncoming traffic before completing his turn. That includes left, right, in front and behind. You do remember the importance of checking your blind spot, right?

He turned left while being passed. My guess is the charges will go in his direction.

As long as the lane they were traveling in was a passing zone the driver of the trailer turning left will be charged.

Without any doubt...this is all the result of careless driving...hard to believe that 2 were walking about after seeing the condition of the truck they were in.!

The roads are dangerous when someone breaks the law. Obviously someone was in the wrong for this to happen. The facts & the witnesses will speak for themselves.
Until these facts are looked at, stop guessing on who is right or who is wrong. Your only guessing cause you dont know the facts & only say what you think you know.
I guess the only good thing to come from this would be the HEMI & all the extras as it looks like a Dodge Ram Rumble Bee Truck, which will be sitting in the scrapyard soon enough for someones streetrod.

Happy to hear nobody was killed.
9/6/2012 8:25:29 AM
Delbert Grady says:
I dont think thats a Rumble Bee truck. Its an SRT/10. Viper V10, not a hemi.

Thats what the badging indicates anyway. Look close, you can see the word Viper on the top of the windshield, and on the hood scoop.

Much better for a rod than any ol 5.7/6.1 hemi could dream of.

Me n My Opinion says:
That truck looks exactly the same as a yellow dodge that passed me heading south on Hwy 61 a couple weeks ago. I was doing about 95, and he/she passed me on a solid yellow line just as we were nearing the crest of a hill. Fortunately it was only in the wrong lane for a couple seconds because it was going about a buck forty.

Not saying for sure that it was the same one, but sure looks suspiciously similar.

This accident was indeed 100% avoidable, Slow Down people!! The driver was trying to be a big shot and impress his friends so sympathy is NOT something he should get from the public
9/6/2012 9:00:51 AM
fiorn says:
How on earth do you know the driver was trying to be a big shot? What if the truck/trailer combo was doing 80km/h going up a hill in the 90 zone? Have you never passed a vehicle?
Like others have said, the trailer turning left is (potentially) at fault if they did not check their blindspot before turning.
All those lines and dashes on the road do actually mean something; you ARE allowed to pass other vehicles.
9/6/2012 9:45:42 AM
westfort resident says:
"Slower-moving vehicles" = drivers actually doing the speed limit. Been tailgated by a truck just like this on Hwy 61. Why are so many people in a rush to end up like this? The Fast and the Furious are movies - quit driving like you're in a Hollywood movie and be responsible. Driving is a privilege, not a right.
9/6/2012 9:43:05 AM
yup says:
The Wolf,

I understand why you would think that a "passing zone" has something to do with this, but unfortunately it does not. It is not illegal to pass on a solid line, or in a "non passing zone" unless there is a sign posted. The line markers are a recomendation of where it is "safe" to pass, not a law to say that you cannot pass.
9/6/2012 9:43:52 AM
The Wolf says:
Never said you couldn't pass on double solid line, merely stated that if it is a passing zone then the person passing can not and will not be charged with the accident. I am fully aware that the lines are the roads are just recommendations for safety.

However if you are ignoring the recommendations of the lines on the road and you cause an accident or close call as a result, well then there are several charges and fines that can will and have been given out.

ah yes "slow down" the answer to every traffic problem....... or sounds like if someone had looked in there mirror..... Every collision is avoidable but it takes two to tango.
9/6/2012 10:02:23 AM
oscarmyerweiner says:
I don't think any "one" person was really at fault, the driver passing was in a passing zone and the driver turning left was turning safely with no vehicles oncoming. Some speculation, the vehicle towing a trailer was slowing down for a reason but was the turning signal working and why would the truck pass on the left when there is a right lane for straight through traffic. I think the truck driver had enough common sense to avoid a fatal accident. Vehicles are replaceable people are not. Very lucky indeed.
9/6/2012 10:37:07 AM
The Wolf says:
You are wrong sorry to say. The person turning has to check their "blindspot" before turning left or right. The turn indicator does not supersede the highway traffic act.

The reason I know this so well is I was involved in 2 accidents identical to this one and both times the person turning was charged with the accident.
9/6/2012 3:37:10 PM
oscarmyerweiner says:
I do believe the person in the front has the right of way. If you are behind him and he is turning left or right you cannot decide to pass him the same side he is turning. If he did not signal how was the truck driver to know he was turning. Maybe this driver was unsure where he was going and it was a last minute decision to turn just as the truck driver decided to pass. More of a coincident than anything. I hope there will be a follow up with the details to this incident.
9/7/2012 1:56:37 AM
The Wolf says:
You may believe but you are wrong.
9/7/2012 1:29:07 PM
oscarmyerweiner says:
State you facts or the highway traffic act. Please and thanks.
9/7/2012 6:49:47 PM
Not The Wolf says:
Technically you are both wrong. Making a left hand turn can be done without any opposing traffic, and in no way needs to check your blind spot. Read the traffic act of ontario before calling someone out.
9/7/2012 8:17:45 PM
The Wolf says:
I am not wrong and am 100% correct. As I stated earlier I have been involved in 2 accidents in this manner and both times the person turning left has been charged. To be totally honest the first time it happened I thought for sure I was going to be charged but I wasn't. The officer cited the violation the other person was charged with but cant recall the act number.

When it happened the second time I had a conversation with the officer and he said that when you are turning you are responsible to ensure you are not going to pull out in front of traffic in either direction.

9/10/2012 1:57:31 PM
oscarmyerweiner says:
Your telling me If I'm turning left it's okay to pass me on my left? Think not. The highway traffic also states that the slower traffic keep as far right as possible when the vehicle behind is passing. This had nothing to do with opposing traffic. And just as I speculated the van did not have working lights on his trailer therefore the truck driver had no way to tell he was turning as he was passing on the left. If his turning signal was working the truck driver would have used the straight keep right lane and kept with the flow of traffic. Now where was I wrong?

9/8/2012 9:20:48 PM
The Wolf says:
Not sure why you find this so hard to believe, you are the also the only one not believing it.

When you are turning you are technically changing lanes and by the regulations you are responsible for checking your blind spot.

Signal for left or right turn
142. (1) The driver or operator of a vehicle upon a highway before turning to the left or right at any intersection or into a private road or driveway or from one lane for traffic to another lane for traffic or to leave the roadway shall first see that the movement can be made in safety, and if the operation of any other vehicle may be affected by the movement shall give a signal plainly visible to the driver or operator of the other vehicle of the intention to make the movement. R.S.O. 1990, c. H.8, s. 142 (1).

If someone is in the act of passing you it is not safe for you to make a turn. You are rquired by the act to know what is going on all around your behicle at all times, not just what is happening in front of you.

trevor316 says:
Everyones's in a big rush...to go nowhere....what is the hurry? passing someone to go a bit faster gains you little to no time...whats the point. let's say they were both going to the border, the vehicle that was passed would show up at customs before the passing vehicle was still in line...

There are some idiots in big lifted trucks with modded diesels who FLY up Hwy 61 all the time.

Anyway....the sad fact is usually these turkeys do OK...it is the car with the family in it that usually pays the price for their being on the road at the same time and place as these yahoos.

I see I'm not the only one who has seen this truck on more then one occasion driving carlessly and recklessly. I've even reported their driving to the police and they did nothing. It's a shame that something like this (or worse) has to happen before something is done. The unfortunate part is this person will be driving again within a week. Someone will eventually go vigilante on them. Hopefully soon because this person needs a rude awakening.

DJS says:
Based on the article, I would assume the first two cars were slowing down because the first one was about to make a left hand turn. The vehicle in question that passed may have been in the right based on the law (time will tell), but after reading the comments, I am assuming that he was an accident just waiting to happen. It is just lucky that no one was killed. Maybe in the future, once he gets his vehicle back on the road, he will make sure that the cars ahead that are slowing down are not doing so to turn left!

@kappa "how young kids drive" Are you wearing blinders? its how stupid people drive until they get into a serious accident that could have had serious consequences. I cannot tell you how many times i've had my ass riden on hwy 2 aka deerfoot in calgary by every type of vehicle. And its not young people. its people that are my parents generation. so don't be sterotyping the driver of the vehicle. People don't know how to drive defensivly no more and expect the unexpected. In the 10yrs i've had my license, i've only been in a accident once. I took the time to go to driving school, and listen to my parents advice on driving. Without taking the time, i'm sure i wouldn't be the driver i am today.

Am I missing something? There are a lot of assumptions going on in this thread.

I see a male pronoun used for a passenger... but why are we assuming the driver is male? Or young? People referring to the driver as a stupid young kid.... why? Because the truck is yellow?

If the truck were beige would we be making these assumptions? Or if it were a minivan? Funny how people judge based on appearances.
9/6/2012 3:44:38 PM

You must of missed something because the driver of the yellow truck was/is a young male and he's been chraged with unsafe passing and carless driving.
