Police arrest intoxicated youth who had a replica firearm

A 17-year-old male was arrested Wednesday after walking in the James Street area with what appeared to be a handgun.

Police received an anonymous call about a young male staggering down the street with a handgun in the James Street and Redwood Avenue area Wednesday just before 9 p.m. Officers were unable to locate the male.

Police then received another call about a male with the same description carrying a gun near a Limbrick townhouse.

Officers found the male and saw the gun in his hand. They drew their firearms and ordered the male to the ground.

The youth complied and was arrested without incident; he was visibly intoxicated at the time of arrest.

It was discovered the gun was an unloaded BB gun that police describe as a black replica handgun.

The youth was charged with possession of weapons dangerous to the public, breach of probation and breach of undertaking.
He has been remanded to Sept. 27.

Thunder Bay Police Service wants to remind people the risk of possessing or using replica guns in public. It can be difficult to determine whether a gun is real or a replica.

You can use it in your back yard or private property. You can even walk down the street to a friends house with it, out of sight, in a bag!

Walking down the road with it in hand, totally different story. It is a weapong dangerous to the public and should be stored while in transport.

(1) Every person commits an offence who, without lawful excuse, uses, carries, handles, ships, transports or stores a firearm, a prohibited weapon, a restricted weapon, a prohibited device or any ammunition or prohibited ammunition in a careless manner or without reasonable precautions for the safety of other persons.

A replica firearm is considered a prohibited device... therefore being drunk and waving one around (ie: careless manner) is contravening the law.

Wow where is the common sense here, so you people think its ok to walk around the street with a bb gun in your hand how does anyone know what it actually is? Is it ok to walk around with a sword in your hand? What about a slingshot, etc. Its just something you don't do!!

way to go barry, better a gun then a knife?? maybe you should grow up...that's all this town neerds are drunk losers with guns in their hands...least with a knife the person has some chance of survival...this city is getting worse by the day, and not all the weird ones are on the streets
