THUNDER BAY - A pre-trial originally scheduled to begin on Tuesday in the case against 18-year-old, Brayden Bushby, who is facing a second-degree murder charge in the death of Barbara Kentner, has been pushed back to allow a new member of counsel to review disclosure in the case.
Thunder Bay attorney, George Joseph, is now representing Bushby along with attorney, Ryan Green. Joseph joined Green on the case on Tuesday and requested more time to review disclosure.
In a Thunder Bay courtroom on Tuesday, Thunder Bay district crown attorney, Andrew Sadler, along with Green and Joseph, agreed to a new judicial pre-trial date of Jan. 26.
“I think it is necessary for Mr. Joseph to review the charge,” said Justice Elaine Burton.
Bushby is accused of throwing a metal trailer hitch that struck Barbara Kentner in the abdomen on the night of Jan. 29, 2017 in the area of Cameron Street. She died in hospital on July. 4 at the age of 34.
Bushby was first charged with aggravated assault but the charge was upgraded on Nov. 3 to second-degree murder.
He was released on bail on Nov. 3 and is required to live with a surety and be with a surety at all times, as well as being banned from contacting several people involved in the case. A publication ban is in place on evidence submitted.
