Horizon Wind Inc. filed a $126-million statement of claim against the city last month after the city failed to sign off on all of the company’s 18 preferred turbine sites for its proposed Big Thunder Wind Park.
The city's deadline to respond to Horizon's statement of claim was Tuesday, but the City of Thunder Bay’s solicitor, Rosalie Evans, said they have instead decided to put a motion before the court to have the matter go to arbitration instead of litigation.
Because of backlogs in the Toronto court system, the earliest the motion could be heard is Jan. 13.
But Evans added that a decision could be expedited if Horizon agrees to move the matter from Toronto to a Thunder Bay court.
