Four months of custody for man guilty of prowling at night, assault

Kenneth Moonias was sentenced on Friday after pleading guilty to one count of trespassing at night, assault and breaching a probation order.

THUNDER BAY -  A Thunder Bay man who was caught checking car door handles and assaulted another man in two separate incidents has been sentenced to four months in custody at the Thunder Bay jail.

Justice Chantal Brochu endorsed the joint sentence for Kenneth Moonias, 29, presented by Crown and defence counsel on Friday, May 1, in Thunder Bay plea court.

Moonias entered guilty pleas to trespassing at night in February and one count of assault and a breach of a probation order from April.

In the first incident that occurred in late February, Crown counsel Piera Pasloski told the court  Thunder Bay police had been called to Amethyst Crescent after receiving reports of two males on private property checking the door handles of cars. When police attended, Moonias was found to be one of those males.

With respect to the second incident, on April 16,  police received reports of a male on the ground being kicked and punched in the head, crown counsel said. It was later determined the assaulting male was Moonias who was bound by a probation order at the time of the offense.

Defence counsel Amy Grann spoke of Moonias’s background including several Gladue factors and mental health diagnoses. At a young age, Moonias was diagnosed with several mental health disorders and was most recently diagnosed with Fetal Alcohol Spectrum Disorder in his early 20s.

Grann also told the court he was exposed to alcohol use at an early age which had played a prominent role in his life and has led to other substance abuse issues.

Moonias was granted credit for pre-sentence custody on an enhanced basis. He has  97 days left to serve going forward on his sentence. After his sentence, he will be placed on an 18-month probation term. Part of his probation will require him to attend counselling and treatment for substance and alcohol abuse if required to do so.

Court also heard Moonias has plans to finish his education and gain stable housing.

He was also given a two-year weapons prohibition.
