THUNDER BAY - A Thunder Bay man who was observed slapping and pushing his partner from the window of their residence has been sentenced to four months behind bars by a Thunder Bay judge.
Kevin Daniels, 39, pleaded guilty to one count of assault and one count of breaching a condition of a probation order. He appeared by audio in Thunder Bay plea court from the Thunder Bay District Jail on Monday, April 27.
Crown counsel Shari Frenette told the court by phone the circumstances of Daniels’s charges that took place on March 1.
The accused came to police attention after a witness observed a male and female fighting inside of a residence from a window. The witness saw the male grab the woman by the arm, slap her and push her to the ground, Frenette said.
The male who was later identified as Daniels was also bound by a probation order at the time he was arrested which required him to be on good behaviour.
Defence counsel Richard Garrett told the court his client has been diagnosed with mental health issues including schizophrenia and ADHD.
Crown and defence counsel submitted a joint sentence recommendation for Daniels which was endorsed by Justice Chantal Brochu.
Daniels was sentenced to a four-month custodial sentence to be followed by an 18-month probation term.
He was also granted credit for the time he has already spent in pre-sentence at the local jail. Going forward, he has 34 days of his sentence left to serve.
Daniels also faces a two-year weapons prohibition.
