Jail time for man who violently attacked ex’s new boyfriend with hammer

THUNDER BAY -  A man has been sentenced to two years less a day for a violent hammer attack where he struck a sleeping, defenceless man.

Skyler Ivall, 22, was sentenced on Wednesday morning, July 8, by Justice Francesco Valente after previously pleading guilty to one count of aggravated assault in connection to an incident last spring.

Court heard by audio from Crown counsel the facts surrounding a violent hammer attack involving Ivall and his ex-girlfriend’s new boyfriend on April 27, 2019.

According to the Crown, Ivall and the complainant had been arguing over Facebook the night before.

Court heard Ivall’s ex-girlfriend woke up in the early morning hours with Ivall standing over top of her with a hammer. Ivall then struck the new boyfriend who was still sleeping three times with a hammer.

Police and paramedics attended and transported the victim to the hospital.

Crown stated the victim sustained several serious injuries including skull fractures, traumatic brain injuries, swelling and required stitches.

Ivall was subsequently arrested at a nearby gas station by police.

Two victim impact statements were entered as exhibits during Ivall’s sentencing which were submitted by the victim and the victim’s sister.

These documents were briefly summarized by the Crown who stated the victim suffers from memory loss, post-traumatic stress disorder and can no longer do certain things he did before the attack.

Ivall spoke briefly when asked by the judge to speak during his sentencing.

“I would like to say sorry for everything that I have done,” he said.

Ivall has been in custody since his arrest and has served 603 days of pre-sentence custody at both the Thunder Bay District Jail and Kenora jail on an enhanced basis.

He will serve an additional two years less a day in a provincial institution which will be followed by a three-year probation term where he will be required to attend counselling for anger management, domestic partner violence and substance abuse.

He will also be required not to communicate with his ex-girlfriend except for the purposes of arranging child care or the complainant and stay away from alcohol and drugs.

He also received a 10-year weapons prohibition order.
