Labour ministry issued orders at waterfront hotel project (2 photos)

Ministry requested appointment of "a competent supervisor"

THUNDER BAY — The Ontario Ministry of Labour recently issued dozens of orders to two contractors and the owner of the property where a new hotel is being built on the city's waterfront. 

All but two of the orders have been carried out, and only one of the orders temporarily halted construction in one area of the project.

BNL Marina Inc. is building the Delta by Marriott Hotel and Conference Centre at Prince Arthur's Landing for the Winnipeg-based ReSolve Group.

A labour ministry spokesperson says inspectors carried out a proactive inspection on June 21 and issued 27 orders to BNL:

  • Orders 1 to 7 pertained to provisions of electrical conductors on a project
  • Order 8 - to keep an electrical panel board free from obstruction
  • Orders 9 and 10 pertained to provisions of a portable and step ladder
  • Orders 11 to 13 pertained to provisions of barriers
  • Orders 14 to 16 were related to guardrail systems
  • Order 17 - to ensure an area where a worker is working is adequately lit
  • Order 18 - pertained to precautions to protect a worker from falling
  • Orders 19 and 20 were related to personal protective equipment
  • Orders 21 and 22 were related to the posting of signs
  • Orders 23 to 26 were related to provisions of scaffolding
  • Order 27 - to provide documentation

Ministry spokesperson Janet Deline said all 27 orders are now in compliance.

Nine orders were also issued to a secondary contractor, Ostim Limited, which is doing the stucco work for the building:

  • Order 28 was related to guardrail systems
  • Orders 29 to 34 were related to provisions of scaffolding
  • Order 35 was a Stop Work order for a specific section of the project until orders 29 to 34 were complied with
  • Order 36 - to provide training records

All these orders were also complied with, and the stop work order was lifted.

However, Deline said two orders issued to the owner, TB Properties LP, after a followup visit on June 22 remain outstanding:

  • For documentation
  • To appoint a competent supervisor

According to Deline, the ministry's investigation is "ongoing."

Authorized representatives of BNL Marina Inc. and Ostim Ltd. could not be reached Wednesday for comment.

Tbnewswatch was also unable to contact Gisele MacDonald, the president of the ReSolve Group. 

A sign posted at the construction site indicates that the eight-storey, 150-room hotel is still scheduled to open in 2018.
