THUNDER BAY — The Law Society of Ontario has revoked Thunder Bay lawyer David Wallace Dubinsky's licence to practise law.
The decision follows a hearing this month by the Law Society Tribunal.
It found that Dubinsky engaged in professional misconduct by failing to respond to and cooperate with eight Law Society investigations over the past two years.
It also determined that the following allegations were established:
- at various times between 2016 and 2018, he failed to serve clients to the standard of a competent lawyer by failing to respond in a timely and effective manner to client communications
- he failed to report important developments to a client including a court date
- he received $6,800 on account of fees for services not yet rendered to a client, which he failed to deposit into a trust account
- he transferred $10,000 from his trust account on account of fees for services rendered to a client without having first delivered a billing to the client
- he practised law while his licence was suspended
Dubinsky's licence was initially suspended for administrative reasons in 2018.
According to the LSO, he was neither present nor represented at the recent hearing which resulted in the revocation of his licence.
He was ordered to pay $15,000 in costs to the Law Society.
