THUNDER BAY - A man has been arrested and charged with one count of assault with a weapon following an incident on Tuesday evening.

Kevin Mitchell Turtle, 32, appeared in Thunder Bay bail court on Wednesday, May 20, and was formally read a charge by Justice of the Peace Zelda N. Kitchekeesik.

It is alleged Turtle assaulted another man with a pipe.

Thunder Bay Police responded to an incident on Tuesday just before 7 p.m. when a male known to a Trillium Place resident attempted to push his way into a home after he was refused entry, according to a police media release.

When the accused male was denied entry, he allegedly pulled out a pipe and began threatening the complainant.

Police say the victim was able to push back and disarm the intruder who fled from the scene. The victim sustained minor injuries.

Officers located Turtle at a nearby address and he was taken into custody without incident.

Crown counsel Derrick Silvestro told the court Turtle had previously been released from custody in April after he had been charged with theft from the LCBO.

The previous order was cancelled on Wednesday and Turtle was released on a new release order with no surety or financial obligation.

Kitchekeesik consented to Turtle’s release with conditions including not to have any contact with the complainant or be 25 metres in his presence, not to possess any weapons, not to attend any LCBO in the city and not to attend the Real Canadian Superstore.

Turtle is expected to return to court next month.
