A Thunder Bay man charged with second-degree murder nearly three years ago is expected to have his case dealt with in the fall.

Eric Lindstrom, 40, was arrested in March of 2009 in connection with the death of 36-year-old Richard Ouimet.

An autopsy of the victim showed he suffered major head injuries.  Ouimet's remains were found burnt in the forest off Highway 527 near Gull Bay.

Lindstrom's trial by jury was scheduled to begin next week, but a motion from the defense on Monday prompted Justice Helen Pierce to cancel those proceedings.

A court date of Oct. 19 has been set where it's anticipated the case will be resolved.

The co-accused in the murder, Christopher Gregorchuk, pleaded guilty more than a year ago to the lesser charge of manslaughter.

He was sentenced to 10 years in jail.
