The three men accused of murdering Robert Topping will be going to trial.

Nick Webber, Sheldon Wabason and Chris Hawk appeared in the Ontario Court of Justice in Thunder Bay on Tuesday. The three men face a second-degree murder charge in connection to the death of 54-year-old Topping as well as a break and enter charge.

The Crown withdrew the charges against Cody Thompson after he died while in custody at the Thunder Bay District Jail.

Justice Frank Valente told the court that while the Crown’s evidence was mostly circumstantial, there was enough for the three accused to stand trial.

“There will be an order to stand trial on both counts,” Valente said.

While a date has yet to be set, the Crown says they hope to have the trial sometime this month.

None of the accusations against the three suspects have been proven in court.
