There’s been a small legal victory for the municipality of Shuniah and people who frequent O'Connor Point.
The summer time hotspot for people in the area has been locked up and closed off to the public since an injunction was granted last year.
The injunction came following a pair of million-dollar lawsuits filed against the municipality.
Families who live nearby say they put up with drinking, excessive noise, trespassing, and stolen and damaged property.
Last October, a Judge ruled in favour of the families and the area was fenced up.
On Tuesday, a leave for appeal was granted to Shuniah.
Council will decide Monday whether to proceed with the appeal, which may not be heard until the fall.
The beach will remain closed until the injunction is lifted.
