THUNDER BAY - Following a new charge of second-degree murder laid against 18-year-old Brayden Bushby in connection to the death of Barbara Kentner, the original charge of aggravated assault has been withdrawn.

The charge was withdrawn in a Thunder Bay courtroom on Monday morning at the request of crown prosecutor, Rob Kozak.

Bushby’s attorney, Ryan Green, requested a new court date of Dec. 4 to allow him time to review the pathology report by the coroner.

Bushby was originally facing a charge of aggravated assault after he allegedly threw a metal trailer hitch from a moving car that struck 34-year-old Kentner in the abdomen on the night of Jan. 29 in the area of Cameron Street. Kentner later died in hospital on July 4.

Bushby was charged with second-degree murder on Nov. 3 after the crown consulted with Thunder Bay Police and the regional coroner.

Bushby was released on bail on Nov. 3 and is required to live with a surety and be with one of his sureties at all times. He is also banned from contacting several people involved in the case. A publication ban is in place on evidence submitted.
