THUNDER BAY — A Thunder Bay man accused of armed robbery of a pizza delivery driver was granted bail on Friday by a justice of the peace.
Colton Herneshuhta, 21, is charged with one count of robbery using a restricted or prohibited firearm, pointing a firearm and two counts of failing to comply with court orders from an Aug. 24 incident.
Herneshuhta is currently serving a sentence for charges related to fraud. Once this sentence expires on Dec. 24, he will be released from custody on bail conditions.
After a bail proceeding on Friday, Dec. 18, a justice of the peace granted Herneshuhta to be released to a surety with several conditions. His surety pledged $5,000 to the courts for Herneshuhta's release.
Upon his release, he will have to reside with his surety, not possess any weapons, not possess or consume any drugs and will have a curfew of 7 p.m. to 8 a.m.
He will also have to present himself at his front door for compliance checks to the police. Herneshuhta must also stay away from the 1000-block of Donald Street East and not contact or communicate with the alleged victim.
While on bail, Herneshuhta will also be on a probation term which will require him to comply with several conditions including participating in rehabilitative programs for substance addictions.
The accused was arrested after police responded to a reported robbery involving a firearm in the 1000-block of Donald Street East on Aug. 24 where police learned a delivery driver had been approached by a man with a suspected handgun while trying to deliver pizzas.
Herneshuhta will return to court on Jan. 21.
