THUNDER BAY -- A local woman convicted of defrauding a local construction company of $200,000 will have to wait another six weeks to find out her sentence.
Kerry Wirkkunen was found guilty of theft over $5,000 in September. She had been charged with falsifying records to cover up a $205,000 theft over a two-year period from A.B.P. Constructors, where she worked as a bookkeeper.
The court finished hearing sentencing submissions Friday morning from both Crown Gordon Fillmore and Wirkkunen’s lawyer Neil McCartney.
McCartney is asking for a conditional sentence to be served in the community of up to two years plus up to three years of probation and 240 hours of community service for his client.
Wirkkunen is a first-time offender and the primary caregiver for her mother, son and husband.
Fillmore is requesting a sentence up two years less a day to be served in jail.
He said the accused’s good character is irrelevant and they were not there to determine if she is a good person.
Fillmore asked for the two-year sentence because of the nature of the fraud; it was committed over two years.
“This is not a one-time impulsive act,” Fillmore said.
Justice F. Bruce Fitzpatrick will give his sentencing decision on Feb. 26.
