Accused in drug-related attempt murder case granted bail

THUNDER BAY — A Peterborough, Ont., man facing charges of attempted murder in connection to a drug-related shooting was freed on bail on Monday following a detention review in the Ontario Superior Court of Justice.

Brandon Wayne Kelly, 27, was arrested by Thunder Bay police in June after officers identified him as a suspect in connection to a May 3 shooting in the city.

Police were dispatched to Thunder Bay Regional Health Sciences Centre after a man had crashed his vehicle into a barricade on the hospital’s property. An investigation revealed the man had been shot prior to his arrival at the hospital.

Kelly was arrested after police executed a search warrant on Sequoia Drive on June 13. Police also located a loaded handgun at the residence.

The accused initially applied for bail in July but was ordered to be detained by a justice of the peace in the Ontario Court of Justice.  A court-ordered publication ban prevents the publications of evidence and reasons for his detainment from this bail hearing.

On Monday, Dec. 21, Kelly appeared in the Superior Court of Justice for a detention review where he was granted bail by Justice John Fregeau.

Court documents show Kelly was released to two sureties who promised to pay a total of $10,000 for his release. He will also be required to wear a GPS ankle bracelet. Kelly is permitted to reside with either of his sureties in southern Ontario but must inform the GPS tracking company when travelling between the two residences, according to his release order. 

Furthermore, he will remain under house arrest conditions. He also cannot possess or consume any drugs and must also attend counselling or treatment for substance abuse issues. 

Kelly is also prohibited from communicating or contacting his co-accused: Terry Pelto, Molly O’Brien, Natalie Salatino and Jacob Daniel Wattie and the alleged victim.

The $10,000 would be forfeited to the court if Kelly breaches any of his conditions.
