Appeal denied

A former city councillor has lost an appeal of a conflict-of-interest judgment and remains barred from serving on city council until December 2014.

A former city councillor has lost an appeal of a conflict-of-interest judgment and remains barred from serving on city council until December 2014.

Robert Tuchenhagen was found guilty last December of being in conflict over a vacant city-owned building he bought in 2008. His most recent appeal, heard in divisional court, was lost when two of three judges upheld the original ruling.

Thunder Bay resident and Furniture Recycle owner Gilles Mondoux filed the original court application against the longtime McKellar Ward councillor, in an attempt to remove him from office.

Tuchenhagen, who did not run in the October 2010 municipal election, used his position to purchase the North Hardisty Street property, Mondoux said at the time.

Mondoux’s claim for restitution was dismissed.

Tuchenhagen on Wednesday said he was disappointed and plans to speak to his lawyer on Thursday to discuss his options.

Tuchenhagen has 15 days to appeal to the Ontario Court of appeal.
