Toronto man sentenced on unlawfully in dwelling charge

THUNDER BAY - A Toronto man appeared in court on Wednesday for sentencing after he pleaded guilty to one count of unlawfully in a dwelling after he was arrested by city police in May.

Javoi Jeremiah Elwood, 18, was arrested in Thunder Bay on May 24 after police responded to a distress call on Ambrose Street.

At the time police alleged the residence had been taken over by a group of drug traffickers. Seven people were arrested including Elwood. Police also seized $9,000 worth of drugs and more than $5,000 in cash.

Federal crown prosecutor Ron Poirier said Wednesday, Sept. 30, police had received a call from the complainant on May 24 indicating there were a number of unwanted individuals in his apartment.

Judge Elaine Burton accepted a recommended sentence for Elwood by the defence and crown.

Elwood was sentenced to time served. He had already accumulated 30 days of pre-sentence custody which was enhanced to 45 days. He spoke briefly to the court to apologize for his actions.

Court also heard from the crown counsel Elwood has outstanding charges from Toronto.

He won’t be released from custody and will be transported to Toronto to deal with those matters, Poirier said.
